The Auto Collectiv - Listing Terms & Conditions

By creating a listing on The Auto Collectiv, you acknowledge that you have read, understood and agree to these Terms & Conditions.

1. Listing Eligibility

By submitting a vehicle listing, you confirm that:

You are at least 18 years of age.
You are the legal owner of the vehicle or have authority from the owner to advertise it for sale.
All information provided is true, accurate and up to date.
The vehicle is legally able to be advertised for sale within Australia.

2. Accuracy of Listings

You are solely responsible for all information contained within your listing, including but not limited to:

Vehicle description
Make and model
Year
Kilometres
Condition
Photographs
Modifications
Price
VIN or registration details (where supplied)

The Auto Collectiv does not verify the accuracy of listings and accepts no responsibility for incorrect, misleading or fraudulent information supplied by sellers.

3. Buyer & Seller Responsibility

The Auto Collectiv is an advertising platform only.

We simply connect buyers and sellers.

We are not involved in:

Negotiating sale prices
Vehicle inspections
Test drives
Payment processing
Transfer of ownership
Delivery or transport
Warranties
Dispute resolution

It is the responsibility of both the buyer and seller to:

Conduct their own due diligence.
Verify the condition and history of the vehicle.
Agree upon the purchase price and payment terms.
Complete the transaction safely and legally.

4. No Guarantee of Sale

Purchasing a listing does not guarantee:

The sale of your vehicle.
Buyer enquiries.
A minimum number of views.
Any financial return.

Listing fees are non-refundable except where required by Australian Consumer Law.

5. Contact Details

By creating a listing, you consent to The Auto Collectiv sharing the contact information you provide, including your email address and phone number, with prospective buyers for the purpose of facilitating genuine enquiries relating to your vehicle.

6. Marketing Communications

By creating an account or listing a vehicle, you consent to receiving marketing communications from The Auto Collectiv, including:

New features
Vehicle news
Marketplace updates
Promotions
Special offers
Newsletter communications

You may unsubscribe from marketing emails at any time using the unsubscribe link provided in our emails.

7. Listing Content

You must not upload content that:

Is false or misleading.
Infringes another person's intellectual property.
Contains offensive, defamatory or unlawful material.
Contains spam or malicious content.
Advertises products or services unrelated to the listed vehicle.

The Auto Collectiv reserves the right to edit, suspend or remove any listing without notice where we believe it breaches these Terms & Conditions.

8. Pricing

All pricing displayed within listings is provided by the seller.

The Auto Collectiv does not guarantee that listed prices reflect market value or represent a fair purchase price.

Buyers and sellers are solely responsible for negotiating and agreeing upon the final sale price.

9. Fraud & Scams

While we take reasonable steps to maintain the integrity of the platform, The Auto Collectiv cannot guarantee that every listing or enquiry is genuine.

Users should exercise caution when buying or selling vehicles and are encouraged to:

Verify identities.
Inspect vehicles before payment.
Avoid unusual payment requests.
Complete transactions safely.

10. Limitation of Liability

To the maximum extent permitted by law, The Auto Collectiv is not liable for:

Losses arising from a vehicle transaction.
Financial loss.
Fraudulent listings.
Misrepresentation by buyers or sellers.
Vehicle defects.
Damage or loss resulting from communications between users.

Your use of the platform is entirely at your own risk.

11. Intellectual Property

By uploading photographs and content, you grant The Auto Collectiv a non-exclusive, royalty-free licence to display, reproduce and promote your listing for marketing and marketplace purposes while your listing remains active.

12. Listing Removal

The Auto Collectiv reserves the right to remove, suspend or archive any listing that:

Breaches these Terms.
Contains misleading information.
Has expired.
Has been sold.
Receives legitimate complaints.
Is otherwise considered unsuitable for the platform.

13. Australian Consumer Law

Nothing in these Terms excludes, restricts or modifies any rights or remedies available under the Australian Consumer Law where such rights cannot legally be excluded.

14. Changes to These Terms

The Auto Collectiv may update these Terms & Conditions at any time. Continued use of the platform constitutes acceptance of the updated Terms.

15. Acceptance

By submitting a listing, you confirm that:

You have read and agree to these Terms & Conditions.
The information you have provided is accurate.
You authorise The Auto Collectiv to display your listing publicly.
You consent to your contact details being shared with prospective buyers.
You consent to receiving marketing communications from The Auto Collectiv.
You understand that The Auto Collectiv acts solely as a marketplace connecting buyers and sellers and is not a party to any vehicle transaction.
